User’s licence agreement of „ Factory of Project „ program owned by 3DVISION company.
Conditions stated below together with decisions constitute legal agreement ( „ Agreement „ ) between final user ( natural person or legal person ) hereinafter “ Licensee “ ,
between Mr Marek Gacek, running the business under the name 3DVISION Gacek Marek, placed in Idzikowice 23K 46-113 Wilków POLSKA, according to register of business activity, Tax Identification Number 752-136-70-89, National Register of Buisness Units hereinafter “ Licensor “,
regarding the computer software called „ Factory of Project „ as follow :
§ 1. DEFINITIONS
In this agreement Parts decide to use the meaning of given below terms as follow :
-„ Program”: means computer program on-line „ FACTORY OF PROJECTS „ operating on-line ( i.e. not requiring installation on the Licensee computer ), also all future amendments, revisions and modifications
“ Internet Website Licensor „ : Internet address http://www.factoryofprojects.com
§ 2. LICENCE OF PROGRAM
Licence, granted according to paragraph 1, include :
- the right to use the program exclusively on personal use of Licensee in the scope and on the conditions described by the agreement ;
- Licensee has the right to start from the webpage www.factoryofprojects.com and use on-line the program.
- Licensee Has the right to use the program for a payment, paying 29 $ / 22EUR / 19GBP - by paying of subscription covering 12 months.
Licensor has and keeps all copyright laws, right to trademark, trade secrets and other ownership laws regarding the Software according to paragraph 1. THE PROGRAM IS PROTECTED COPYRIGHT LAWS AND OTHER OWNERSHIP INTELLECTUAL LAWS.
§ 3. LIMITATIONS OF USE THE PROGRAM
With the proviso to articles of copyright law and related laws Licensee cannot :
- Permanently or temporarily multiple the Program in total or in part by any means or in any form :
- to observe, study or test function of the Program, in particular in order to learn ideas or rules of the program :
- To use the program in a way to contravene the law, in particular the act dated on 18th of July 2002 about providing the services by electronic way ( Dz.U. Nr 144, poz. 1204 with latest changes ) :
- To use the program in a way contravening good customs ;
- All use of shapes/library ( aside from Licensor knowledge ) from the program „FACTORY OF PROJECTS" is strictly prohibited.
- All attempts oriented on breaking the codes of the program is strictly prohibited.
- This licence agreement forbids spreading the files *.pfp, loga, company’s name and distributing of the login and password to third parties without the permission of 3DVISION, that is Licensor.
§ 4. UPDATING THE PROGRAM
Licensor reserves the right of broading the program according to his own discretion for additional elements and functions as well as fixing, updating and modifying it.
LICENSEE CLEARLY STATES, THAT HE IS FAMILIARIZED WITH THIS AGREEMENT AS WELL AS HE IS FULLY AWARE HIS RIGHTS ALSO OBLIGATIONS AND CONDITIONS ESTABLISHED ON THE STRENGTH OF THE DECISIONS OF THIS AGREEMENT.
BY CLICKING THE BUTTON „ I accept :, LICENSEE EXPRESSES THE APPROVAL OF SUBMITING TO THE CONDITIONS AND ADMIT TO THE LICENSOR RIGHT ACCORDING TO THIS AGREEMENT.
